Terms of Service

1. Acceptance of Terms

By accessing or using PaintGuard AI ("Service"), operated by PaintGuard ("we", "us"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

PaintGuard AI provides AI-assisted paint quality inspection by analyzing user-submitted photos of vehicles. Reports are generated by large-language-model vision systems and are intended as an informational aid for automotive professionals.

Reports are not a substitute for in-person inspection by a qualified technician. PaintGuard AI does not guarantee detection of every defect and does not certify vehicles fit for sale, insurance, or any other purpose.

3. User Accounts

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use.

4. Subscription & Billing

• Subscriptions renew automatically each month until cancelled.
• Per-month inspection limits reset on the billing-cycle anniversary.
• Fees are non-refundable except where required by law, or at our sole discretion.
• We may change pricing with 30 days' notice, effective at the start of your next billing cycle.

5. Acceptable Use

You agree not to:

• Upload photos of vehicles you do not have the right to inspect.
• Use the Service to defraud, deceive, or misrepresent a vehicle's condition to a buyer, insurer, or third party.
• Reverse engineer, scrape, or redistribute the AI outputs at scale.
• Use the Service in violation of any applicable law.

6. Content & Ownership

You retain ownership of the photos you upload. You grant us a limited license to process, store, and analyze those photos to provide the Service. We may use de-identified, aggregated data to improve the models. We do not sell your photos.

We own the generated reports, analytics, and software. You may use reports for any lawful business purpose.

7. Data Retention

Photos are retained in our storage for up to 90 days and then automatically deleted. Report text and metadata are retained for the life of your account so you can reference historical inspections. You may request deletion of your data at any time (see Privacy Policy).

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED REPORTS WILL BE ACCURATE OR COMPLETE.

9. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim arising from the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, consequential, or punitive damages.

10. Termination

We may suspend or terminate your account at any time for breach of these Terms. You may cancel at any time from your billing page; access continues through the end of the paid period.

11. Changes

We may update these Terms from time to time. Material changes will be emailed to you at least 14 days before taking effect.
